1. Overview

PlagShield respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement that are reported to our designated copyright agent.

2. Copyright Infringement Claims

If you believe that your copyrighted work has been copied and made available through our service in a way that constitutes copyright infringement, you may submit a DMCA takedown notice.

3. Filing a DMCA Takedown Notice

To file a DMCA takedown notice, please provide the following information:

3.1 Required Information

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
  • Information reasonably sufficient to permit us to contact you (address, telephone number, email address)
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

4. Our Response to DMCA Notices

Upon receiving a valid DMCA takedown notice, we will:

  • Promptly investigate the claim
  • Remove or disable access to the allegedly infringing material if we determine it is appropriate
  • Notify the user who posted the material about the takedown
  • Provide the user with information about filing a counter-notice if they believe the material was removed in error

5. Counter-Notice Process

If you believe that your material was removed or disabled as a result of mistake or misidentification, you may file a counter-notice with us.

5.1 Counter-Notice Requirements

Your counter-notice must include:

  • Your physical or electronic signature
  • Identification of the material that has been removed and the location at which it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of federal court in your district
  • A statement that you will accept service of process from the person who provided the original DMCA notice

5.2 Counter-Notice Response

Upon receiving a valid counter-notice, we will:

  • Provide a copy of the counter-notice to the original complainant
  • Inform the complainant that we will restore the removed material in 10 business days
  • Restore the material unless the complainant files a court action seeking an injunction

6. Repeat Infringer Policy

We have adopted and implemented a policy that provides for the termination of user accounts in appropriate circumstances of users who are repeat infringers. We may terminate a user's access to our service if they are determined to be a repeat infringer.

7. False Claims

Please note that under Section 512(f) of the DMCA, anyone who knowingly makes a material misrepresentation in a DMCA notice or counter-notice may be subject to liability for damages. We reserve the right to seek damages from any party that submits a false or fraudulent DMCA notice or counter-notice.

8. Accommodation of Standard Technical Measures

We accommodate and do not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, provided that such measures are consistent with our service operations.

9. Limitation of Liability

We act as a service provider and are not liable for copyright infringement by our users. We comply with the safe harbor provisions of the DMCA and will remove infringing material when properly notified.
